Conditions and Terms The placement and purchase of an order with Chico Race Works constitute the acknowledgment and acceptance of all terms and conditions listed below. Chico Race Works reserves the right to make changes to its website and terms and conditions at any time. PRICESAll prices listed in our website, advertisement and/or catalog do not include shipping & handling charges. All prices are mail order prices; extra fees may apply for pick up or will call. All prices and descriptions are subject to change without notice. Orders shipped to California residents must include 9.25% sales tax.TYPOGRAPHICAL ERRORSIn the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from the supplier or manufacturer, Chico Race Works shall have the right to refuse or cancel any order placed for product listed at the incorrect price. Chico Race Works shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, Chico Race Works shall immediately issue a credit to your credit card account in the amount of the charge.WARNINGAll parts sold by Chico Race Works, except for street legal/DOT approved parts are racing parts for off road use only. Federal and many State laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting the vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle. Chico Race Works shall not be liable for any special, direct, indirect, incidental or consequential damages that might be claimed as a result of the failure of any part, including claims for delay, loss of profits, or labor. Chico Race Works shall not be liable for any damage or injury to persons or property resulting from improper installation or misuse of any part. Chico Race Works will not cover any loss in profit or labor due to errors in shipping, mispackage, and/or extended delays for backorder items. Chico Race Works shall not be held accountable for any misconception or disappointment associated with any product.SPECIAL ORDERSChico RaceWorks will determine special order items. All special ordered items must be prepaid before processing your order. Special ordered items cannot be cancelled or returned.PAYMENTChico RaceWorks accepts all major credit cards via PayPal, Western Union, money orders, and certified checks payable to Chico Race Works. All orders paid by credit card must be shipped to the cardholder's billing address or verified alternate shipping address. Orders will NOT be shipped if the address provided does not match the records of the credit cardholder's bank. Please DO NOT send cash, as we are not responsible for any loss that may occur with the US Postal Service.SHIPPINGAll orders are shipped by either UPS or US Postal Service. In stock items usually ship within 24hrs after receipt of order. Chico Race Works does not guarantee on time deliver for out of stock items. Any expected shipment dates given to customer are approximate. Out of stock items will be placed on backorder. Backorder items will ship within 24hrs after receipt of shipment from manufacturer. Shipping fees calculated by our shopping cart system are estimated. Shipping fees may be higher than stated by our shopping cart system for products using oversized boxes, multiple box shipments and backordered items.REJECTION OF GOODSAs soon as the goods are delivered to Buyer, he shall inspect them. Notice in writing must be given within five (5) days after receipt of goods of any defect or omissions. Failure to give notice within five (5) days after receipt shall constitute an irrevocable acceptance of the goods.CLAIMSClaim for defective goods, shortages, incorrect items, delays, or failures in shipment or delivery, or for any other cause, shall be deemed waived and released by Buyer, unless made in writing within five (5) days after the arrival of the goods.RETURNSAll items returned are subject to a 25% (twenty-five percent) restocking fee. RETURNS ARE NOT ACCEPTED on ignition systems, computers (ECU), any electrical items, bulbs, lighting accessories, software, internal engine components, fuel pumps, special orders and custom orders. All other returns or exchanges are accepted within 30 days after date of invoice. All returns must be unused, in the same condition as sold to buyer and in its original packaging. Returned parts with missing packaging, instructions, or parts will be subject to a restocking fee. It is the customer's responsibility to contact Chico Race Works within this time period to be eligible for a return. No returns or exchanges will be allowed if the item shows signs of having been installed, scratched, damaged or modified. If Chico Race Works does not accept a returned item as being defective and/or returnable for any reason, the buyer must accept any incurred cost. It is the responsibility of the customer to verify the correct part before ordering and installing a particular part. Chico Race Works is not responsible for shipping costs incurred by the customer for returning products for return, refund, exchange, and/or warranty.REFUNDSA refund, exchange or core return will not be made until all items are returned to Chico Race Works. Shipping and handling charges are non-refundable. Refused shipments sent back to Chico Race Works do not constitute a refund or credit. Chico Race Works reserve the right to charge the customer shipping & handling costs for the refused shipment and a 25% restocking fee.INTERNATIONAL ORDERSAll orders outside of the United States must be paid in full. All foreign orders are final. No returns will be accepted; therefore it is the buyer's responsibility to order the correct part. Chico Race Works does not guarantee proper fitment for buyer's foreign vehicle as all parts sold by Chico Race Works are made for the American domestic market. Customer is responsible for taxes, duties, and brokerage fees incurred thru customs.WARRANTYAll products sold by Chico Race Works are only subject to the manufacturer's warranty. Manufacturer warranty will not be honored if the customer's mishandling, abuse or faulty installation causes the defect. |
